Job Purpose

TMF Group is looking for a Senior Privacy Officer to support further embedding and driving the group privacy programme within its globally operating Regional Delivery Centres and Hubs (RDCs). The RDCs Privacy Officer will be part of the Group Privacy Office reporting into the Chief Privacy Officer. The Group Privacy Office is part of the Group Legal and the Global Legal Function headed by the Group General Counsel. The role will primarily endeavour to enable the RDCs employees and TMF Group businesses relying on the RDCs and Hubs to adequately handle personal data as part of their business activities. This position is principally oriented to providing expert guidance enabling data protection compliant RDCs operations. Ancillary activities include involvement in the Group Privacy Office, Group Legal and Global Legal Function programmes and projects, as well as guiding and supporting the Group Legal and Global Legal Function team members and execution of the global legal priorities related to the group data protection compliance.

You will report directly report to the Chief Privacy Officer and there will be matrix reporting to the RDCs leadership. You will be primary contact for the RDCs data protection compliance matters, and business client-facing and support lines.

At this role you will be part of:

  • Part of the Group Privacy Office, Group Legal and the Global Legal Function headed by the Group General Counsel
  • Member of the Global Privacy Team
  • Member of the RDCs Data Protection Compliance, Risk and/or Quality Assurance Committee

At this role you will have possibility to work fully remotely. 

 

Key Responsibilities:

  • Overall responsibility for the global RDCs data protection compliance, providing advice and guidance to the business and business coordinators from data protection perspective, for each of the RDCs legal entities;
  • Assist with the monitoring and management of processing operations and risk mitigation, in line with TMF Group privacy policies, procedures and guidelines;
  • Develop and provide specific employee training and supporting material to the RDCs staff;
  • Responsible for coordinating data protection compliance matters with the Group Privacy Office, aligning the RDCs activities to TMF Group’s data protection compliance strategy and providing guidance to the Market’s Legal Counsels and Compliance Officers;
  • Overall responsibility for the RDCs in investigating incidents, data subject requests from data protection compliance perspective, and ensuring relevant issues are handed in a timely, legally compliant manner;
  • Provide guidance and advice on ad hoc data protection compliance matters and manage and track data protection compliance issues raised by the business;
  • Drafting, reviewing and negotiating data processing clauses, data processing and data transfer agreements related to the RDCs, taking into account the risk-based approach as appropriate and consistent with the TMF Group data protection strategy and contracting guidelines from the Group Legal – Client Contracting Team and the Group Privacy Office;
  • Assist with the preparation and execution of the BCR data protection auditing programme, and general monitoring of effectiveness of data protection strategy in coordination with business functions, compliance and the Group Privacy Office;
  • Act as a subject matter expert for audits initiated by TMF Group clients or the national data protection supervisory authorities and prepare relevant responses to inquiries from the other relevant supervisory authority or any other legal or regulatory bodies;
  • Support RDCs related data subject access request responses through initial analysis, providing guidance for responses and coordinating collection of requested information;
  • Responsible for monitoring and guidance with maintaining and updating the RDCs records of processing activities (RoPA) in alignment with the business process owners;
  • Drive completion of data protection impact assessments and coordinate advice and input from various stakeholders as required;
  • Lead, promote and advocate data protection compliance following TMF Group’s data protection compliance programme for the benefit of the RDCs and the local offices serviced by it;

 

Key Requirements:

  • Lawyer with legal qualification LLM, with 6+ years relevant PQE in one of the European jurisdictions;
  • Demonstrable understanding and at least 4 years of continuous and verifiable experience with Privacy and Data Protection laws/regulations in a similar role;
  • Experience in private service-oriented practice with a law firm or as an in-house counsel (SME);
  • Understanding of data protection audit processes, data protection working best practices, and the assessment of ISO certifications from a data protection perspective;
  • Ability to effectively and efficiently communicate with senior management and decision-makers within the TMF Group;
  • Working experience with data protection compliance software, e.g. OneTrust (desirable);
  • Reliable and ability to work under pressure and within strict timelines;
  • Motivated and capable of managing own workload with a sense of priority and flexibility;
  • Ability to work in matrix management and interact with external parties: suppliers, service providers, clients and other third parties;
  • Strong sense of discretion and high ethical standards;
  • Excellent communication and coordination skills in order to interact with various departments, across different countries;
  • CIPP/E certification or equivalent is a plus;
  • Project management skills (desirable);
  • Excellent knowledge of Microsoft 365;
  • Fluent in English.
